Issuing proceeding against a debtor is often a costly and time consuming process especially when the summons is defended. Many people simply do not issue proceedings through the county court because of the high costs that are often involved.

P & B Collection Services provides an alternative to simply having to write off accounts by allowing the client to issue proceedings through the courts at reduced costs. The options are:-

Option 1.

If you would prefer to have total control over the enforcement process we are able to prepare a summons in-house.

Many clients choose this service when the claim is unlikely to be defended. We charge a flat rate fee of £25.00 per case for preparation of the summons. There would also be the county court issue fees to pay.

The advantage of having a summons prepared in-house and what many clients feel benefit them most is that they are fully aware at all time as to what stage the enforcement process is at, as all county court paperwork is sent directly to them. This in turn gives greater control over the enforcement process.

Once judgment is obtained and dependant upon what further action is available we would prepare the necessary documentation for enforcement of the debt at no extra cost to the client.

The client should bear in mind that we are not solicitors and would only prepare a claim form from the information supplied. Should the case be defended then we would not be able to represent you in court. It may also become necessary to seek legal advice in the future.

Option 2.

If you believe the case will be defended and that legal representation in court is going to be required or would prefer a solicitor to deal with the case then 'option 2'  would be best advised.

Once instructed we would pass the case to our solicitors for them to instigate legal proceedings through the courts on your behalf.

Every case is assessed independently as to the viability of pursuing it through the courts. We or the solicitors would discuss with you all aspects of the case and the likely costs that would be involved before any legal action is commenced.
